Rental Terms & Conditions

  1. Rental Agreement.  The individual making this booking (the "Booking Party") acknowledges that each rider (the "Renter") within his/her/their group must agree to these terms and conditions (the "Terms") and sign a rental agreement before riding a Cleveland Adventure Company, LLC ("CAC") bicycle.  CAC reserves the right to cancel any booking if any Renter refuses to agree to these Terms and/or sign the rental agreement.

  2. Assumption of Risk.  Renter acknowledges that the activities for which the Bicycle is designed include inherent dangers, including the risk of bodily injury and/or death.  Renter assumes and accepts all risks associated with the use of the Bicycle.

  3. Minimum Age.  Renter acknowledges that CAC’s minimum rental age for e-bikes is eighteen (18) years of age, and Renter agrees to provide CAC with proof of identification (e.g., driver's license or passport) prior to rental.  CAC reserves the right to cancel a rental if Renter fails to provide proof of sufficient age.

  4. Acceptable Use.  Renter agrees and acknowledges that he/she will be the sole operator of the Bicycle, and will use the Bicycle in a careful, safe and conscientious manner.  Renter shall at all times observe and adhere to any rules and guidelines posted by CAC, and any applicable laws and regulations, including but not limited to, local traffic ordinances.

  5. Prohibited Activities.  Renter acknowledges and agrees that CAC reserves the right to cancel his/her rental if Renter violates any of the following rules and regulations during his/her operation of the Bicycle:

    1. There are no passengers permitted on the Bicycle unless expressly permitted by CAC in writing prior to use.

    2. There is no cell phone usage while operating the Bicycle.

    3. Renter cannot operate the Bicycle while under the influence of drugs or alcohol.

    4. Renter must wear his/her helmet at all times while operating the Bicycle.

  6. Unsafe Use.  If at any time CAC determines that Renter has engaged in an unsafe or hazardous use of the Bicycle, CAC may immediately terminate the rental.  Upon notification of termination, Renter must immediately return the Bicycle to the designated return area.  If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her security deposit. CAC shall determine, in its sole discretion, whether any behavior or activity is “unsafe or hazardous.”

  7. Inclement Weather.  CAC reserves the right to cancel a rental, in its sole discretion, if it determines the weather to be unsafe for bicycle operation.  

  8. Condition of Bicycle upon Return.  The Renter shall return the Bicycle to the designated return area clean and in the same condition as it was in when given to Renter, excepting ordinary wear and tear.  Renter shall be responsible for any damage caused to the Bicycle during the rental period.  CAC shall retain any portion (or all) of Renter’s security deposit as necessary to cover repairs for such damages.  To the extent that damages to the Bicycle exceed the amount of the security deposit, Renter shall be billed by CAC for the full amount of damages caused by Renter during the rental period, including reasonable attorney’s fees.

  9. Late Return.  If Renter returns the Bicycle to the designated return area more than 15 minutes after the scheduled “Time Back,” Renter shall forfeit his/her security deposit.
